  • The client’s document retention management is surveyed.  The electronic discovery process is greatly simplified if a company adheres to sound retention policies.
Identification
  • Identify key players that will be involved in the process
  • Determine the location of the data
  • Identify relevant data and timeframes
  • Interview potential custodians
  • Create an “LRP” (Litigation Response Plan)
  • Map IT Systems
  • Protect and stop the destruction of existing data
Preservation
  • Ensure that electronically stored information (“ESI”) is protected against inappropriate alteration or destruction.
Collection
  • Extract data and determine if full forensic data capture is necessary
